NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. GIVEAWAY BEGINS AT 11:00:00 AM (ET) ON JANUARY 25, 2010 AND ENDS AT 11:59:59 PM (ET) ON FEBRUARY 28, 2010.
1. HOW TO ENTER: To enter Lifetime Moms’ Vacation Giveaway (the “Sweepstakes”) (a) go to http://www.lifetimoms.com (the “Website”), (b) click on the featured connection to the Sweepstakes on the “Just For Fun” page of the Website and (c) complete the Sweepstakes registration process, including acceptance of these Official Rules, and then click on the “Enter” button (individually an “Entry” and collectively, “Entries”). ALL ENTRIES MUST BE RECEIVED BY 11:59:59 PM (ET) ON FEBRUARY 28, 2010. The Website's database clock will be the official timekeeper for this Sweepstakes. Entry Limit: one (1) entry per person per day. Entries received in excess of the entry limit will be void. For the purpose of this Sweepstakes, each day will begin at 12:00:00 AM (ET) and end at 11:59:59 PM (ET), with the exception of the first day of this Sweepstakes which begins at 11:00:00 AM (ET) on January 25, 2010. No incomplete, forged or altered Entries will be accepted. All Entries become the exclusive property of Lifetime Entertainment Services, LLC (“Sponsor”) and will not be returned. In the event of any dispute concerning the identity of any entrant, the relevant Entry will be deemed submitted by the authorized account holder of the applicable email address used to enter.
2. SELECTION OF WINNER: One (1) Grand Prize winner will be determined from all eligible Entries received in a random drawing to be conducted on or about March 5, 2010 by Sponsor or its representatives, whose decisions are final on all matters relating to this Sweepstakes.
3. GRAND PRIZE AND ODDS: One (1) Grand Prize of a Walt Disney World Resort Vacation Package consisting of (a) one (1) round trip coach class airfare for Grand Prize winner and each of three (3) guests (“Guests”) from a major commercial airport nearest Grand Prize winner’s residence to Orlando International Airport, Orlando, Florida; (b) one (1) round trip ground transportation transfer from the Orlando International Airport to the Walt Disney World Resort for Grand Prize winner and each Guest; (iii) standard hotel accommodations in a deluxe Walt Disney World Resort hotel for five (5) days/four (4) nights for Grand Prize winner and Guests (one room/maximum occupancy four (4) persons), such accommodations to be selected by Lifetime in its sole discretion; (iv) one (1) five (5)–day Magic Your Way free pass, with five (5)-day Park Hopper option for Grand Prize winner and each Guest, which includes park hopping for free entry to Disney Hollywood Studios, Epcot Magic Kingdom Theme Park and Disney Animal Kingdom, (v) one (1) Disney Gift Card with a value of $500 for Grand Prize winner; and (vi) complimentary use of Disney transportation provided within the Walt Disney World Resort. All other expenses, costs and incidentals not specifically mentioned as being included are excluded and are the Grand Prize winner’s sole responsibility, including, but not limited to, air transfers, luggage fees, additional ground transportation, taxes, fees, tips, gratuities, phone calls, hotel activities, souvenirs, gift shop purchases, spa treatments, meals, travel documents, service charges and trip, travel and/or other insurance. Approximate Retail Value (“ARV”) of Grand Prize: $4,888. The ARV of the Grand Prize trip may vary depending upon the point of departure, destination, and fare fluctuation. Any difference between the stated ARV and the actual value, if any, will not be awarded. Grand Prize winner is not entitled to receive cash equivalent for the Grand Prize (or any prize component). All travel arrangements, including but not limited to travel routes, airports selected, air carriers, seat locations, and hotel reservations, are in Lifetime’s sole discretion and must be made through Lifetime or its agents (and may be subject to change by Lifetime). All Grand Prize details are subject to availability, holiday and blackout dates and other restrictions. All tickets issued are subject to terms and conditions of their issuers. Except in Lifetime’s sole discretion, Grand Prize may not be changed, extended, exchanged or transferred. If a change to the Grand Prize is permitted by Lifetime, any and all associated change fees or restructuring are the sole responsibility of the Grand Prize winner and no refunds or credits will be allowed. Grand Prize trip must be completed by December 31, 2010. If Grand Prize winner cannot take and complete trip by that date, Grand Prize is subject to forfeiture, in which event, Lifetime will have no further obligation to Grand Prize winner. Lifetime reserves the right, in its sole discretion, to substitute the Grand Prize (or prize component) with one of equal or greater value. If any portion of the Grand Prize is cancelled, postponed or otherwise unavailable for any reason, Lifetime will have no obligation to award compensation in lieu thereof, that portion of the Grand Prize will be cancelled or subject to substitution in the sole discretion of Lifetime, the remainder of the Grand Prize will be awarded, and Lifetime will have no further obligation to Grand Prize winner. Grand Prize winner and Guests must travel together on the same itinerary. If any Guest is a resident of a jurisdiction that deems her/him to be a minor (“minor”), then the Grand Prize Winner or one of the other Guests must be the minor’s parent or legal guardian. Each Guest (or the parent/legal guardian of any minor Guest) will be required to execute a Release of Liability prior to departure. Grand Prize winner and Guests are solely responsible for providing all necessary identification documents and will be responsible for obtaining all necessary travel documents prior to travel. Failure to provide such documents may result in trip cancellation upon airport check-in. Grand Prize winner or one of the Guests must have and present at least one (1) major credit card in good standing in order to check into the Walt Disney Resort hotel. If Grand Prize winner elects to travel without one or more or any Guests, no additional compensation will be awarded and any portion of the Grand Prize allocated to any Guest that does not travel may be forfeited. Grand Prize winner and Guests must comply with all applicable venue rules and failure to do so may result in forfeiture of the Grand Prize. The trip restrictions/conditions stated herein are not all-inclusive and may be subject to additional restrictions/conditions, which may be stated in the affidavit/releases (described below) and/or Grand Prize winner’s travel documents. Odds of winning the Grand Prize depend upon the number of eligible Entries received. The Grand Prize will be awarded to the Grand Prize winner (assuming a sufficient number of eligible Entries is received and, after reasonable attempts, a verified winner is found). Lifetime is responsible only for prize delivery and is not responsible for prize utility, quality or otherwise. Taxes and fees, and all other costs associated with acceptance and use of the Grand Prize, if any, are the sole responsibility of Grand Prize winner.
4. ELIGIBILITY: Sweepstakes is only open to individual legal residents of the 50 United States and District of Columbia, who are the age of majority or older in their respective states of residence as of January 25, 2010, except that officers, directors and employees (and their immediate families and members of the same household) of Sponsor, Disney Destinations, LLC (“Disney’) and their respective parents, subsidiaries, affiliates, agents, judges and advertising and promotion agencies are not eligible to enter or win.
5. NOTIFICATION AND VERIFICATION OF PRIZE WINNER AND DELIVERY OF PRIZE: Grand Prize winner will be notified by email and/or phone using the contact information provided upon registration and associated with her/his winning Entry. Grand Prize winner may be required to sign an affidavit of eligibility and liability release and, where permitted, a publicity release. If a potential winner does not respond within three (3) days of the first winner notification attempt, or if her/his prize notification or prize is returned as undeliverable or unclaimed, or if such potential winner’s affidavit/release is not returned within three (3) days after it was mailed to her/him, or if such potential winner declines a prize for any reason prior to award, is found to be ineligible, or cannot or does not comply with these Official Rules, such potential winner may be subject to disqualification, her/his prize subject to forfeiture and an alternate winner may be selected in a random drawing from all remaining eligible Entries received. Grand Prize winner agrees to Sponsor’s use of her/his name, city, state, likeness, and/or prize information for promotional purposes in any medium without additional compensation to the extent permitted by law.
6. GENERAL: This Sweepstakes is void outside the United States and where prohibited or restricted by law and is subject to all applicable federal, state and local laws and regulations. This Sweepstakes will be governed by the internal laws of the State of New York. Any and all legal actions or claims arising in connection with this Sweepstakes must be brought in a court of competent jurisdiction within the United States. Sponsor, Disney and their respective parents, successors, subsidiaries and affiliated companies, advertising and promotion agencies, prize suppliers, judges, printers, distributors, and any respective officers, directors, employees, representatives and agents of each, and any other person or entity related in any way to this Sweepstakes (together with Sponsor, the “Sweepstakes Entities”) are not responsible for: (a) late, lost, stolen, damaged, garbled, incomplete, misaddressed, postage due or misdirected Entries, e-mails or other communications; (b) errors, omissions, interruptions, deletions, defects or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices or transmission lines; (c) data corruption, theft, destruction, loss, unauthorized access to or alteration of entry materials; or (d) electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind or insufficient space in entrant's e-mail account to receive e-mail messages. The use of automated software or computer programs to register or to enter this Sweepstakes is prohibited and any individual who uses or attempts to use such methods to register or to enter will be disqualified. Sweepstakes Entities disclaim any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with, this Sweepstakes. Sponsor reserves the right, at its sole discretion, to modify, cancel, terminate or suspend this Sweepstakes and to hold a random drawing from among all eligible, non-suspect Entries received prior to such action, if any virus, bug, technical failure, unauthorized human intervention or other cause outside of Sponsor’s control corrupts or affects the administration, security, fairness, integrity or proper conduct of this Sweepstakes. In the event of any such modification, cancellation, termination or suspension, a notice of such action will be posted online at the Website, if possible. Sponsor reserves the right, in its sole discretion, to disqualify any entrant (and all of her/his Entries) from this Sweepstakes or any other promotion conducted now or in the future by Sponsor or any of its affiliated companies, if such entrant tampers with the entry process or if her/his fraud or misconduct affects the integrity of this Sweepstakes. Sponsor reserves the right to correct clerical or typographical errors in promotional materials. By participating in this Sweepstakes, each entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of Sponsor and warrants that she/he is eligible to participate in this Sweepstakes. In addition, each entrant by participating in this Sweepstakes, agrees on her/his behalf (and on behalf of her/his heirs, executors and administrators) to release, discharge, indemnify and hold the Sweepstakes Entities harmless from and against any and all liability, loss (including death or injury) or damage (including property damage), of any kind, resulting, in whole or in part, directly or indirectly, from her/his participation in this Sweepstakes or any Sweepstakes-related activity or from the award, acceptance, possession, misuse or use of any prize or participation in any prize-related activity.
7. CAUTION. ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANYONE MAKING SUCH AN ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
8. WINNER’S NAME: To obtain prize winner’s name, send a self-addressed, stamped envelope to: Lifetime Moms’ Dream Vacation Giveaway Winner’s Name Request, Lifetime Entertainment Services, LLC, 111 8th Avenue, 11th Floor, New York, NY 10011, Attn: New Media Department. Prize winner’s name request must be received by February 28, 2010. Prize winner’s name will be sent after selection and verification of winner. Prize winner’s name also will be available on www.lifetimemoms.com after selection and verification of winner.
